Terms, Legal info and Conditions

 

BEFORE SUBMITTING YOUR APPLICATIONS AND ANY FORMS OR ORDERS ON OUR WEBSITE, PLEASE READ ALL RULES AND REGULATIONS. THE TERMS AND CONDITIONS ARE IMPOSED BY LONDON YOUNG MUSICIAN (HEREAFTER THE COMPETITION), A SERVICE OWNED BY WORLD CLASSICAL MUSIC LTD, OFFICE 201 10 COURTENAY ROAD EAST LANE WEMBLEY HA9 7ND, ENGLAND AND WALES, VAT 431136143, CRN 14356008. BY SUBMITTING THE APPLICATION FORM, THE CANDIDATES OR THEIR PARENTS OR LEGAL GUARDIANS UNDERSTAND AND ACCEPT THESE REQUIREMENTS, RULES AND REGULATIONS.

1. Seasonal Competitions and Annual Competition (Musician of the Year)

1.1 All London Young Musician competitions are held by online video submission eg. through YouTube upload. Applications from musicians who are under the age of 18 must be filled and submitted by a parent or legal guardian.

1.2 For seasonal competitions, candidates can choose to enter into more than one category if they wish. If they do, candidates will need to submit additional application forms. Applicants will need to pay for each category the candidate enters into. 

1.3 For seasonal competitions, candidates can only play one musical instrument for each application. An additional musical instrument will need to be submitted as another application.

1.4 For seasonal competitions, candidates can apply in the same category with different instruments. They can also apply into different categories with different instruments.

1.5 For seasonal competitions, candidates can submit separate videos for different pieces.

 

1.6 For seasonal competitions, jury members who are currently teaching or have taught a candidate in the past two years must refrain from assessing their performance(s).

1.7 All candidates of the seasonal competitions will receive an official certificate in digital format, ready for printing. Only the Prize/Award winners are qualified to order the winner trophy, which is at an additional cost. All participates can order the paper certificate at an additional cost.

1.8  The international jury’s decisions are final and not to be discussed. The individual jury’s votes, marks and opinions are strictly confidential and will not be published.

 

1.9 For seasonal competitions, depending on candidates' instruments/voice type/categories/ages, the competition committee will decide and send their videos to different portions of judges, from the published seasonal jury members. Marks will be given based on the quality of the candidates' overall performance and musicianship.   

1.10 For seasonal competitions, the Jury panel will give each candidate’s performance a mark out of 100. An average mark of 96-100 will be awarded the Platinum Prize; An average mark of 90-95 will be awarded the Gold Prize; An average mark of 80-89 will be awarded the Silver Prize; An average mark of 70-79 will be awarded Bronze Prize. An average mark of 65-69 will be honourably mentioned. An average mark of under 65 will not be awarded a prize. There is no limited number for the seasonal prize winners.

1.11 For seasonal competitions, Special Prizes are awarded to those candidates who have shown a special and unique side of themselves in their video performance.

 

1.12 Only the seasonal winners who achieve a certain number of award points are qualified to apply for the annual competition – "Musician of the Year". No additional application fee is required for this year-end competition. (See 5. Award Point section for more details). We may increase the number of award points in need to participate Musician of the Year from time to time. We normally only do this in incremental steps but we’ll publish the notice (such as through information on our website, social media or newsletter)

1.13 For Musician of the Year, competition video must be submitted before the announced deadline. Late submission is not accepted. The application will be failed if the video submitted does not meet the following requirements: i) Candidates must say the sentence "London Young Musician of the Year 20xx", or hold up a piece of paper with this sentence written on it, to the camera at the beginning of the performance. The performance and speech/paper holding must be recorded in one take; ii) The performance video must be newly recorded and specifically made for the year-end competition. Previously recorded performance video(s) will not be accepted. Editing a speech clip onto old video(s) is also not allowed; iii) When performing a different piece/instrument with a new camera angle, candidates must say/show the opening speech again. This is to ensure the performance were newly recorded and specifically made for the year-end competition; iv) Each candidate can only send one video – this video can include one or more pieces, and it must meet the requirement of the limited time for the category.

 

1.14 For Musician of the Year, all instruments/vocal are competing together in the same category. It is an independent competition which consists of a First Round, Semi-final Round and a Final Round (livestream) using the same video submitted. Each round has a different jury panels. First Round results are based on jury voting. A certain number of the candidates will be selected to the Final Round according to their marks gained in Semi-final Round. Final round competition videos will be livestreamed on Facebook, Instagram and Youtube channel.  First Prize, Second Prize and Third Prize ​​will be awarded to one winner only in each category.

1.15 For Musician of the Year, the required amount of points will be deducted from the total points after the candidate successfully participated in the 'Musician of the Year'. The deducted points will still be counted in the same year ranking. The amount required for Musician of the Year will be announced in each Season 3.

1.16 For Musician of the Year, audience votes on all platforms need to be coming from real accounts. London Young Musician reserves all the rights to deduct suspicious votes from fake accounts and to determine the final valid audience votes.

2. General Condition for Competitions and Online Events

2.1 The application fee is non-refundable. 

2.2 Applicants must submit the video before the deadline. If the applicant is willing to change the video, he/she must send a clear email request with one video link before the application deadline. Any irresolute instructions, indecisive, misleading information may cause the applications refused.

2.3 Instrumentalists other than the piano can send their performances with or without accompaniment. In the case of having accompaniment in the video, the accompanist will not be judged. Only the contestant’s performance will be judged and scored by the jury members.

2.4 The competition video submitted must contain the exact pieces for the chosen category. Submitting a long video and specifically ask to use part of it for the competition is not allowed. Doing this may cause the applications refused.

2.5 For the professional standard, the judgement and comments will be made exclusively upon material received. Any personal conditions or other additional accomplishments of a candidate must not be mentioned to jury members, and will not be considered into judging. The judgement and comments will be made exclusively upon the received candidate's performance quality. Candidates, parents must not attempt to contact jury members or pass any personal messages to jury members during the judging period.

 

2.6 To ensure the fairness of the competitions, contacting a jury member for any topic or matter regarding London Young Musician during the competition adjudication period (the day after the deadline until the day the results publish) is strictly prohibited. Any Candidate, parent of the Candidate, who makes an attempt, or on whose behalf any attempt is made, to communicate with any member of the Jury during the adjudication period may face penalties such as disqualification, removing all previous award points, banning from further entries to the competition. This is also to ensure jury members give their marks without taking any external influence and pressure.

2.7 The international jury’s decisions are final and not to be discussed. The individual jury’s votes, marks and opinions are strictly confidential and will not be published. 

2.8 If the application fee has been refused, or charged back, in any case, the application will be considered as cancelled, and any previously submitted applications will be withdrawn automatically. 

2.9 By participating in all events hosted by London Young Musician, (include but not limited to seasonal competitions, mid-season concerts, Musician of the Year) the applicant grants London Young Musician all rights to use and publish the candidate's name, likeness, recordings, and other material in accordance with the Competition needs (promotion, social media, etc.) with no expectation of payment.

2.10 Each candidate is responsible for copyright/ownership of the audio/video/photo they submit to the London Young Musician competitions and online events.

2.9 During the application process, the Competition collects necessary personal data from the application form, this data being necessary for the various procedures of the Competition. The data is held on a secure database and only the following information is made public: family name, first name, biography, photographs. The unpublished information is not shared with third parties. Competitors have a right to view their data, and they can request, in writing, to have their data amended or refuse permission for its use once the Competition has ended.

2.10 We reserve the right to change the conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.

2.11 To the fullest extent permitted by law, we hereby exclude and shall not have any liability to any entrant or prize winner in connection with or arising out of any Competition howsoever caused, including for any costs, expenses, forfeited prizes, damages and other liabilities.

2.12 London Young Musician reserves the right of exclusion of the publication from the competition record and history in case of damage to the reputation of London Young Musician brand.

3. Prizes and Free Gifts

3.1 London Young Musician will take no responsibility for the Prize awarded after delivery. There is no insurance, tax, or warranty that comes with the Prizes and we cannot be held responsible for the Prize or any costs it incurs once handed over to the Winner. We are not responsible for paying the bank transaction fee for the Cash Awards.

3.2 All physical prizes and free gifts are non-exchangeable, non-transferable and no cash alternatives will be offered.

 

3.3 It is your responsibility to ensure that the delivery address you give us is correct and accurate and that there is somebody to sign for and take delivery of the goods from the delivery service used. If the prize is returned to us because the courier, or you provided inaccurate address, or postal service could not complete the delivery to you for whatever reason, then you will be responsible for the redelivery costs.

4. Trophy Order and other Paid Physical Item

4.1  It is your responsibility to check and understand the product details and safety notice provided on the product pages before placing the orders. The weights, measurements, sizes dimensions and capacities shown on the Site are provided as a best estimate only variations in the manufacturing processes, your monitor settings and your computer hardware may affect the fabrics and designs of the Products meaning that Products delivered may have minor differences in appearance to how they are displayed and described on the Site.

4.2 Be aware that: the colours which are shown on the Site will depend on many factors – including your computer display settings; and we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the products on delivery and/or receipt. The weights, measurements, sizes dimensions and capacities shown on the Site are provided as a best estimate only variations in the manufacturing processes, your monitor settings and your computer hardware may affect the fabrics and designs of the Products meaning that Products delivered may have minor differences in appearance to how they are displayed and described on the Site.

4.3 All Products are subject to availability - we may not be able to supply your order.

4.4 We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order. It is your responsibility to ensure that the delivery address you give us is correct and accurate and that there is somebody to sign for and take delivery of the goods from the delivery service used. If your order is returned to us because the courier or you provided inaccurate address, or postal service could not complete the delivery to you for whatever reason, then you will be responsible for the redelivery costs.

 

4.5 All orders are delivered using a registered courier. We cannot be held responsible for any delays once the goods have left us and are in possession of the courier. We are unable to guarantee the delivery time will not be affected by unforeseen issues affecting our carrier. Under these circumstances, we do not issue any form of compensation. ​Should your item not be delivered within the regular shipping time frame, we are pleased to offer our assistance in contacting the courier for a thorough investigation. If the courier confirms that the item has been lost, we will provide you with the option to either have the item resent or receive a refund. 

4.6 You will become the owner of the goods you have ordered when they have been dispatched to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

4.7 We make no promise that materials on our website are appropriate or available for use in locations outside the United Kingdom, and accessing the website from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

4.8 For customized physical item orders, returns and exchanges are not acceptable. For non-customized physical item orders, if you are not completely satisfied with your order for any reason, you have the right to return them within 14 working days, which commence from the date of delivery, for credit or refund. It is your responsibility to return goods in their original pristine condition and packaging. Any costs incurred by you in returning your goods shall be your responsibility unless previously agreed by ourselves.

4.9 When ordering products for delivery outside of mainland UK you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges. Customs policies vary widely from country to country, so you should contact your local customs office for further information.

5. Award Point and LYM World Ranking System

5.1 When using London Young Musician Competition Service (provided by World Classical Music Ltd), we may provide you with opportunities to acquire a limited license to access award points, associated with your competition account (collectively, “Virtual Content”). When you earn award points, you only get a license to access it for special events such as London Young Musician of the Year. You have no ownership in any of the award points you gain and you can’t transfer it to someone else. Award point and ranking have no monetary value, are generally game-specific and you can’t redeem award points for any type of “real world” money or obtain any refunds. When you obtain an award point from us, what we are actually giving you is a personal, non-exclusive, non-transferable, non-sublicensable, revocable, limited right and license to use that Virtual Content only in connection with your use of the applicable London Young Musician Services.

5.2 In an effort to constantly improve the London Young Musician, evolve our competitions and keep it safe, fun, and secure, we have the right to delete, alter, move, remove, or transfer any and all award points, in whole or in part, at any time, with or without notice to you, and with no liability of any kind to you. We won’t delete your award points without notice (such as through posts on our website, social media or email) unless your competition account and participation qualification are terminated by us for a legitimate reason or by you under section 2.6. We may sometimes change the number of award points in need for certain special events (for example, we might increase the number of award points needed to enter special events, such as London Young Musician of the Year). We normally only do this in incremental steps but we’ll publish the notice (such as through information on our website, social media or newsletter) if we plan to make changes that will significantly impact your award points. We don’t provide or guarantee, and expressly disclaim, any value, cash or otherwise, attributed to any data residing on servers we operate or control, including any award point attributed to your account.

5.3 It costs a certain amount of award points to participate in the 'Musician of the Year' in April. The required amount of points will be deducted from the total points after the candidate successfully participated in the 'Musician of the Year'. The amount required for Musician of the Year 2021-22 will be announced in 2021-22 season 3.

5.4 ​Highest Mark Ranking and Award Points Ranking are calculated after every seasonal competition. The Top 1 winner will receive a medal and will be invited to perform in LYM mid-season online concert in October. World Musicians Ranking 2021-22 is calculated according to the total score of the winner gained in LYM 2021-22 competition year (including 2021-22 Season 1 to Season 4, and Musician of the Year 2022). 5.5 For Chamber Music category, if the application is under one performer's name, all award points will be given to this performer; if the application is under a group or several performers, award points will be given to the group or split among all performers. The London Young Musician reserves all rights for final explanation of the specific distribution amount of award points.

 

London Young Musician reserves the right, at its sole discretion, to change, modify, add or delete any part of these Terms at any time without further notice to you. We recommends that you revisit these Terms regularly to keep informed of the current Terms that apply to your use of the Website and the delivery of your products. Your continued access and use of the Website after any changes or updates constitutes your acceptance of the new Terms. It is your responsibility to regularly check the Website and determine if there have been any changes to these Terms.
